Signer's requirements
To receive a service, the signer must:
- be physically present;
- show valid identification;
- willingly sign, acknowledge, give oath or affirmation, and be aware when performing the notarial act;
- the documents for notarization must be complete and without blanks.
- leave a thumbprint if asked during the notarization;
- For signature by mark, in addition to the disabled signer, there are two witnesses who must sign the document.
Note* The Illinois Notaries Public are not allowed to determine which type of certificate a signer must use. To do so would be considered practicing law without a license. A Notary can only ask the signer which form they prefer and provide different certificates for them to select.
If the signer still does not know, they will be referred to the document's originator or a lawyer for an answer.
Although we cannot help you decide which certificate to use, we can help you understand the difference. Learn more>>
JURAT is used when the signer swears at the document's content. The Notary must administer an oath or affirmation to the signer to complete the jurat. The signer signs in the presence of the notary.
ACKNOWLEDGEMENT is used to verify the identity of the signer and to confirm that they signed the document. They are not swearing to the truthfulness or validity of the document; they are simply acknowledging that they signed it. In the state of Illinois, a signer is not required to sign the document in the presence of the notary public, but they are required to personally appear in front of the notary to confirm their signature.
